    President Trump Implements Steel and Aluminum Tariffs

    June 23, 2025 —
    Los Angeles, Calif. (June 4, 2025) - On May 30, 2025, President Donald Trump announced to rallygoers in Pennsylvania that his administration would soon double the tariff on imported steel from 25 percent to 50 percent. On June 3, 2025, President Trump issued a Proclamation that formally doubles the tariffs on steel articles and derivative steel articles, as well as doubling the tariffs (to 50 percent) on aluminum articles and derivative aluminum articles. As was widely anticipated, the Proclamation was issued pursuant to section 232 of the Trade Expansion Act of 1962 (“Section 232”). A President may issue Section 232 tariffs if the Secretary of Commerce finds that there is a threat to U.S. national security, which the former Secretary of Commerce first did in President Trump’s original administration.     No Cross-Complaint Needed: Contractor Can Fight Co-Defendant’s Summary Judgment

    October 21, 2025 —
    In a decision of first impression, the California Court of Appeal in RND Contractors, Inc. v. WRSE (2025) 112 Cal.App.5th 697, clarified whether a co-defendant may oppose another defendant's motion for summary judgment without having first filed a cross-complaint. The case arose from the collapse of a high school gymnasium during construction, leading to negligence, wrongful death, and premises liability claims against the project participants. The court held that "any adverse party" may oppose another party's motion for summary judgment, even if the Plaintiff does not oppose the motion and there is no cross-complaint filed by the co-defendant opposing summary judgment. This ruling resolves a novel procedural question which had not been addressed by any Court of Appeal in California to date. Read the full story...

    OSHA Aims to Address the Long Summer Days

    August 05, 2025 —
    As the summer progresses, construction projects across the country will undoubtedly take advantage of the warmth and dry conditions to move towards completion. These long summer days can also lead to concern on the project site, particularly as it relates to the safety of workers exposed to the heat. In response to the potential dangers that heat exposure can cause, the Occupational Safety & Health Administration (“OSHA”) introduced its first-ever proposed standard titled “Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings” in 2024. The proposed rule, if implemented, will apply to all employers conducting outdoor and indoor work in all general industry, construction, maritime, and agricultural sectors where OSHA has jurisdiction. However, the proposed rule excludes short-duration employee exposure to heat. Among other requirements, the proposed rule introduces several key requirements aimed at protecting workers from the hazards of excessive heat. If it is implemented, the proposed rule requires employers to conduct regular heat assessments and monitor workplace temperatures. Read the full story...

    Two Paths to Industrialized Construction: Lessons from China

    May 19, 2025 —
    Chinese construction has been in the headlines for record-breaking speed: a 10-story residential building erected in 28 hours and 45 minutes, or a 57-story skyscraper built in 19 working days. These projects rely on meticulous planning, extreme prefabrication, and clockwork execution. Besides those unique showcase projects, I wanted to learn how Chinese AEC firms are industrializing construction at scale. My recent conversation with three China Construction Third Engineering Bureau (CSCEC 3rd Bureau) experts shed light on two breakthrough technologies that exemplify this shift. Two strategies for industrialization As the construction industry evolves, two powerful strategies are emerging to drive industrialization: bringing construction into the factory or bringing the factory to the construction site.     The Court Rules in Favor of Partners Benjamin Price and Ajay Ahluwalia’s Arbitration Ruling Awarding Damages!

    September 23, 2025 —
    The action involved a large-scale tenant improvement project for a manufacturing facility in Los Angeles County. BWB&O’s client served as the general contractor for the project. During the project, the owner terminated the construction contract for cause. The general contractor, through BWB&O, initiated arbitration proceedings asserting claims for Breach of Contract and Breach of the Implied Covenant of Good Faith and Fair Dealing. BWB&O argued there was no basis for termination and thus, per the terms of the contract, the owner was liable for approximately $700,000.00 in termination costs incurred by BWB&O’s client. The owner asserted counterclaims against BWB&O’s client for Breach of Contract, Negligence, Breach of Duty of Good Faith and Fair Dealing, Malicious Prosecution, and Declaratory Relief, seeking no less than $1,500,000.00.
